Selling the Family Home by Agreement

When both parties are able to reach agreement, selling the family home is usually more straightforward and less stressful.

1. Reaching an Agreement Together

You and your former spouse can agree to sell the property and divide the proceeds between you. As part of that agreement, it is helpful to clearly decide:

  • Who (if anyone) will remain living in the home until it is sold
  • Which estate agent you will use
  • How you will value or price the property
  • Who will pay ongoing expenses such as the mortgage, insurance and utilities
  • How you will divide the sale proceeds once legal and selling costs are deducted

Your solicitor can then formalise this agreement in writing and, where appropriate, incorporate it into your divorce settlement or consent terms lodged with the court.

2. One Solicitor Can Often Handle the Sale

If both parties agree and no conflict of interest arises, one solicitor can often handle the conveyancing (the legal work involved in selling the property). As a result, the process can remain simpler and more cost-effective.

However, either party can still seek independent legal advice at any stage if needed.

Selling the Family Home by Court Order

In some cases, agreement is not possible. In those situations, the court may need to make a decision.

1. What Can the Court Order?

A judge can order the sale of the family home and direct how the proceeds should be divided to ensure proper provision for both spouses and any dependent children.

In practice, the court may:

  • Set a timeframe for the sale
  • Appoint one solicitor to act on the sale, or
  • Direct that both parties’ divorce solicitors have joint carriage of sale, meaning they work together to manage the process.

2. If One Person Will Not Cooperate

Sometimes, one party may delay or block the sale — for example, by refusing access for viewings or failing to sign contracts. In those cases, the court can make further orders to allow the sale to proceed.

In more complex situations, the court may appoint a receiver or another third party to complete the sale on behalf of one or both parties.

Who Pays the Costs of Selling the Family Home?

In most cases, the costs associated with selling the home — including estate agent’s fees, legal costs and any final outgoings — are paid from the sale proceeds before dividing the balance.

Where the parties reach agreement, it will usually include provisions to deal with what happens if one party does not cooperate. As a result, this helps avoid either person having to fund large costs upfront and provides clarity if difficulties arise.
